Meet Up Now App End User License Agreement
This End User License Agreement (“Agreement”) is between you and Meet Up Now and governs use of this app made available through the Apple App Store. By installing the Meet Up Now App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the Meet Up Now App.<
To ensure Meet Up Now provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the "Report as offensive" feature found under each post.1. Parties This Agreement is between you and Meet Up Now only, and not Apple, Inc. (“Apple”). Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. Meet Up Now, not Apple, is solely responsible for the Meet Up Now App and its content.2. Privacy Meet Up Now may collect and use information about your usage of the Meet Up Now App, including certain types of information from and about your device. Meet Up Now may use this information, if it is in a form that does not personally identify you, to measure the use and performance of the Meet Up Now App.3. Limited License Meet Up Now grants you a limited, non-exclusive, non-transferable, revocable license to use the Meet Up Now App for your personal, non-commercial purposes. You may only use the Meet Up Now App on Apple devices that you own or control and as permitted by the App Store Terms of Service.4. Age Restrictions By using the Meet Up Now App, you represent and warrant that (a) you are 17 years of age or older and you agree to be bound by this Agreement; (b) if you are under 17 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the Meet Up Now App does not violate any applicable law or regulation. Your access to the Meet Up Now App may be terminated without warning if Meet Up Now believes, in its sole discretion, that you are under the age of 17 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child's use of the Meet Up Now App, you agree to be bound by this Agreement in respect to your child's use of the Meet Up Now App.5. Objectionable Content Policy Content may not be submitted to Meet Up Now, who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker.6. Warranty Meet Up Now disclaims all warranties about the Meet Up Now App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Meet Up Now, not Apple, shall be solely responsible for such warranty.7. Maintenance and Support Meet Up Now does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, Meet Up Now, not Apple, shall be obligated to furnish any such maintenance or support.8. Product Claims Meet Up Now, not Apple, is responsible for addressing any claims by you relating to the Meet Up Now App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Meet Up Now App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.9. Third Party Intellectual Property Claims Meet Up Now shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the Meet Up Now App. To the extent Meet Up Now is required to provide indemnification by applicable law, Meet Up Now, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Meet Up Now App or your use of it infringes any third party intellectual property right.

This Privacy Policy applies to websites, apps, events and other services operated by Meet up now. For simplicity, we refer to all of these as our “services” in this Privacy Policy. To make it extra clear, we’ve added links to this Privacy Policy on all applicable services.
Some services may require their own unique privacy policy. If a particular service has its own privacy policy, then that policy -- not this Privacy Policy -- applies.INFORMATION WE COLLECT
It goes without saying, we can’t help you develop meaningful connections without some information about you, such as basic profile details and the types of people you’d like to meet. We also collect information generated as you use our services, for example access logs, as well as information from third parties, like when you access our services through a social media account. Information you give usYou choose to give us certain information when using our services. This includes:o When you create an account, you provide us with at least your login credentials, as well as some basic details necessary for the service to work, such as your gender and date of birth.o When you complete your profile, you can share with us additional information, such as details on your personality, lifestyle, interests and other details about you, as well as content such as photos and videos. To add certain content, like pictures or videos, you may allow us to access your camera or photo album. Some of the information you choose to provide us may be considered “special” or “sensitive” in certain jurisdictions, for example your racial or ethnic origins, sexual orientation and religious beliefs. By choosing to provide this information, you consent to our processing of that information.o When you participate in surveys, focus groups or market studies, you give us your insights into our products and services, responses to our questions and testimonials.o When you choose to participate in our promotions, events or contests, we collect the information that you use to register or enter.o If you contact our customer care team, we collect the information you give us during the interaction. See below for more details:o Usage InformationWe collect information about your activity on our services, for instance how you use them (e.g., date and time you logged in, features you’ve been using, searches or search parameters, clicks and pages which have been shown to you, referring webpage address, advertising that you click on) and how you interact with other users (e.g., users you connect and interact with, time and date of your exchanges, number of messages you send and receive).o Device informationWe collect information from and about the device(s) you use to access our services, including:o hardware and software information such as IP address, device ID and type, device-specific and apps settings and characteristics, app crashes, advertising IDs (such as Google’s AAID and Apple's IDFA, both of which are randomly generated numbers that you can reset by going into your device’ settings), browser type, version and language, operating system, time zones, identifiers associated with cookies or other technologies that may uniquely identify your device or browser (e.g., IMEI/UDID and MAC address); ando information on your wireless and mobile network connection, like your service provider and signal strength.o Other information with your consentIf you give us permission, we will be able to collect your precise geolocation (latitude and longitude) in order to offer you features that make use of it. Such geolocation is collected through various means, depending on the service and device you’re using, including GPS, Bluetooth or Wi-Fi connections. If you decline permission for us to collect your geolocation, we will not collect it.
Similarly, if you consent, we may collect your photos and videos (for instance, if you want to publish a photo, video or streaming on the services).
COOKIES AND OTHER SIMILAR DATA COLLECTION TECHNOLOGIES
We use and may allow others to use cookies and similar technologies (e.g., web beacons, pixels) to recognize you and/or your device(s). Sharing of information laid out in Section 6 sometimes involves cross-border data transfers, for instance to the United States of America and other jurisdictions. YOUR RIGHTS
We want you to be in control of your information, so we have provided you with the following tools:
o Access / Update tools in the service. Tools and account settings that help you to access, rectify or delete information that you provided to us and that’s associated with your account directly within the service. If you have any question on those tools and settings, please contact our customer care team for help here.
o Turning off or on your location to be seen on the map.

o Device permissions. Mobile platforms have permission systems for specific types of device data and notifications, such as phone book and location services as well as push notifications. You can change your settings on your device to either consent or oppose the collection of the corresponding information or the display of the corresponding notifications. Of course, if you do that, certain services may lose full functionality.o Deletion. You can delete your account by using the corresponding functionality directly on the service.We want you to be aware of your privacy rights. Here are a few key points to remember:o Reviewing your information. Applicable privacy laws may give you the right to review the personal information we keep about you (depending on the jurisdiction, this may be called right of access, right of portability or variations of those terms). You can stop all information collection by an app by uninstalling it using the standard uninstall process for your device. If you uninstall the app from your mobile device, the unique identifier associated with your device will continue to be stored. If you re-install the application on the same mobile device, we will be able to re-associate this identifier to your previous transactions and activities.o Accountability. In certain countries, including in the European Union, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal information. The data protection authority you can lodge a complaint with notably may be that of your habitual residence, where you work or where we are established.RESIDENTS OF CALIFORNIA

We keep your personal information only as long as we need it for legitimate business purposes (as laid out in Section 5 and as permitted by applicable law.
In practice, we delete or anonymize your information upon deletion of your account, unless:we must keep it to comply with applicable law;
we must keep it to evidence our compliance with applicable law;
there is an outstanding or potential issue, claim or dispute requiring us to keep the relevant information until it is resolved; or
the information is kept for our legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, information may need to be kept to prevent a user who was banned for unsafe behavior or security incidents from opening a new account.
Keep in mind that even though our systems are designed to carry out data deletion processes according to the above guidelines, we cannot promise that all data will be deleted within a specific timeframe due to technical constraints.
CHILDREN’S PRIVACY
Our services are restricted to users who are 18 years of age or older. We do not permit users under the age of 18 on our platform and we do not knowingly collect personal information from anyone under the age of 18. If you suspect that a user is under the age of 18, please use the reporting mechanism available through the service.

Effective on 6/01/2021California subscribers: You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. If you subscribed using an External Service (e.g., Apple ID, Google Play), you must cancel through your External Service, as set forth in more detail in Section 8a. If you subscribed through your Apple ID, refunds are handled by Apple/Google, not Meet up now. You can request a refund from Apple through your Apple ID account on your phone or at https://getsupport.apple.com. All other users may request a refund by contacting Meet up now Customer Service at booksmart.team @ gmail (dot) com, or by mailing or delivering a signed and dated notice that states that you, the buyer, are canceling this agreement, or words of similar effect. Please also include your name and the email address, phone number, or other unique identifier you used to sign up for your account. You are legally qualified to enter a binding contract with Meet up now;
You are seeking new friends or relationships.
You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country;
You are not on any list of individuals prohibited from conducting business with the United States;
You are not prohibited by law from using our services;
You have not have been convicted of or pled no contest to a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence;
You are not required to register as a sex offender with any state, federal or local sex offender registry;
You do not have more than one account on our Services; and
You have not previously been removed from our Services by us, unless you have our express written permission to create a new account.
If at any time you cease to meet these requirements, you must immediately delete your account, and we retain the right to remove your access to our services without warning.

If you cancel your subscription, you will continue to have access to your subscription benefits until the end of your subscription period, at which point is will expire.Because our Services may be utilized without a subscription, canceling your subscription does not remove your profile from our Services. If you wish to fully terminate your membership, you must terminate your membership as set forth in Section 9.8a. EXTERNAL SERVICE PURCHASES AND SUBSCRIPTIONSExternal Service Purchases, including subscriptions, may be processed through the External Service, in which case those purchases must be managed through your External Service Account. The subscription will not be renewed when your then-current term expires.If you initiate a chargeback or otherwise reverse a payment made with your External Service Account, Meet up now may terminate your account immediately in its sole discretion. Meet up now will retain all funds charged to your External Service Account until you cancel your subscription through your External Service Account. Certain users may be entitled to request a refund. See Section 8b below for more information.8b. REFUNDSGenerally, all purchases are nonrefundable. If you no longer wish to use our Services, or if we terminate your account for any reason, here’s what you need to know.

However, you will need to cancel / manage any External Service Purchases through your External Service Account (e.g., iTunes, Google Play) to avoid additional billing.Meet up now reserves the right to investigate and, if appropriate, suspend or terminate your account without a refund if you have violated these Terms, misused our Services, or behaved in a way that Meet up now regards as inappropriate or unlawful, on or off our Services. We reserve the right to make use of any personal, technological, legal, or other means available to enforce the Terms, at any time without liability and without the obligation to give you prior notice, including, but not limited to, preventing you from accessing the Services.If your account is terminated by you or by Meet up now for any reason, these Terms continue and remain enforceable between you and Meet up now, and you will not be entitled to any refund for purchases made. EXTERNAL SERVICE PURCHASES AND SUBSCRIPTIONSExternal Service Purchases, including subscriptions, may be processed through the External Service, in which case those purchases must be managed through your External Service Account. Subscriptions automatically renew until you cancel.When making a purchase on the Service, you may have the option to pay through an External Service, such as with your Apple ID or Google account (“your External Service Account”), and your External Service Account will be charged for the purchase in accordance with the terms disclosed to you at the time of purchase and the general terms applicable to your External Service Account. Some External Services may charge you sales tax, depending on where you live, which may change from time to time.If your External Service Purchase includes an automatically renewing subscription, your External Service Account will continue to be periodically charged for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, the subscription will automatically continue for the price and time period you agreed to when subscribing.To cancel a subscription: If you do not want your subscription to renew automatically, or if you want to change or terminate your subscription, you must log in to your External Service Account and follow instructions to manage or cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the App from your device. You can also request assistance at https://getsupport.apple.com. Similarly, if you subscribed on Google Play, cancellation is handled by Google. To cancel a purchase made through Google Play, launch the Google Play app on your mobile device and go to Menu > My Apps > Subscriptions, then find your Meet up now subscription and follow the instructions to cancel. You can also request assistance at https://play.google.com. If you cancel a subscription, you may continue to use the cancelled service until the end of your then-current subscription term. The subscription will not be renewed when your then-current term expires.If you initiate a chargeback or otherwise reverse a payment made with your External Service Account, Meet up now may terminate your account immediately in its sole discretion. Meet up now will retain all funds charged to your External Service Account until you cancel your subscription through your External Service Account. Certain users may be entitled to request a refund. If you choose to pursue a claim against Meet up now, these terms will apply.14a. ARBITRATION, CLASS-ACTION WAIVER, AND JURY WAIVERIf you pursue a legal claim against Meet up now, you agree to arbitration (with limited exceptions).Except for users residing within the EU or European Economic Area, and where prohibited by law:The exclusive means of resolving any dispute or claim arising out of or relating to this Agreement (including any alleged breach thereof) or our Services shall be BINDING ARBITRATION administered by JAMS under the JAMS Streamlined Arbitration Rules & Procedures, except as modified by our Arbitration Procedures. The one exception to the exclusivity of arbitration is that either party has the right to bring an individual claim against the other in a small-claims court of competent jurisdiction, or, if filed in arbitration, the responding party may request that the dispute proceed in small claims court if the party’s claim is within the jurisdiction of the small claims court. If the responding party requests to proceed in small claims court before the appointment of the arbitrator, the arbitration shall be administratively closed, and if requested after the appointment of the arbitrator, the arbitrator shall determine if the dispute should be decided in arbitration or if the arbitration should be administratively closed and decided in small claims court. Whether you choose arbitration or small-claims court, you may not under any circumstances commence or maintain against the Company any class action, class arbitration, or other representative action or proceeding.
By using our Services in any manner, you agree to the above arbitration agreement. In doing so, YOU GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend any claims between you and the Company (except for matters that may be taken to small-claims court). YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER CLASS PROCEEDING. Your rights will be determined by a NEUTRAL ARBITRATOR, NOT A JUDGE OR JURY, and the arbitrator shall determine all issues regarding the arbitrability of the dispute. You are entitled to a fair hearing before the arbitrator. The arbitrator can grant any relief that a court can, but you should note that arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons. For details on the arbitration process, see our Arbitration Procedures.
Any proceeding to enforce this arbitration agreement, including any proceeding to confirm, modify, or vacate an arbitration award, may be commenced in any court of competent jurisdiction. In the event that this arbitration agreement is for any reason held to be unenforceable, any litigation against the Company (except for small-claims court actions) may be commenced only in the federal or state courts located in San Mateo County, California. You hereby irrevocably consent to the jurisdiction of those courts for such purposes.
The online dispute settlement platform of the European Commission is available under http://ec.europa.eu/odr. Meet up now does not take part in dispute settlement procedures in front of a consumer arbitration entity for users residing in the EU or European Economic Area.
14b. GOVERNING LAW
California Law and the Federal Arbitration Act will apply if there is a dispute (except in the EU and where prohibited by law).Except for users residing in the EU or European Economic Area or elsewhere where our arbitration agreement is prohibited by law, the laws of California, U.S.A., excluding California’s conflict of laws rules, will apply to any disputes arising out of or relating to this Agreement or our Services. Notwithstanding the foregoing, the Arbitration Agreement in Section 15a above shall be governed by the Federal Arbitration Act. For the avoidance of doubt, the choice of California governing law shall not supersede any mandatory consumer protection legislation in such jurisdictions.15c. VENUEAny claims that are not submitted to arbitration for any reason must be litigated in San Mateo County, California (except for claims brought in small claims court, and in the EU or where prohibited by law).Except for users residing in the EU or European Economic Area, who may bring claims in their country of residence in accordance with applicable law, and except for claims that may be properly brought in a small claims court of competent jurisdiction in the county or other jurisdiction in which you reside or in San Mateo County, California, all claims arising out of or relating to this Agreement, to our Services, or to your relationship with Meet up now that for whatever reason are not submitted to arbitration will be litigated exclusively in the federal or state courts of San Mateo County, California, U.S.A. You and Meet up now consent to the exercise of personal jurisdiction of courts in the State of California and waive any claim that such courts constitute an inconvenient forum.INDEMNITY BY YOU
You agree to indemnify Meet up now if a claim is made against Meet up now due to your actions.
You agree, to the extent permitted under applicable law, to indemnify, defend, and hold harmless Meet up now, our affiliates, and their and our respective officers, directors, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities, and expenses, including attorney’s fees, due to, arising out of, or relating in any way to your access to or use of our Services, Your Content, Your conduct toward other users, or your breach of this Agreement.ACCEPTANCE OF TERMS
By using our Services, you accept the Terms of this Agreement.
By using our Services, whether through a mobile device, mobile application, or computer, you agree to be bound by (i) these Terms, which we may amend from time to time, (ii) our Privacy Policy and Cookie Policy, and (iii) any Additional Terms Upon Purchase. The Terms supersede all previous agreements, representations, and arrangements between us, written or oral. If any provision of these Terms is held invalid, illegal, or otherwise unenforceable, the remainder of the Terms shall continue in full force and effect. The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You agree that your Meet up now account is non-transferable and all of your rights to your account and its content terminate upon your death, unless otherwise provided by law. Any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction. No agency, partnership, joint venture, fiduciary or other special relationship or employment is created as a result of these Terms, and you may not make any representations on behalf of or bind Meet up now in any manner.SPECIAL STATE TERMS
